Canada Updates Eligibility for Open Work Permits for Family Members of Temporary Residents

Eligibility for International Students

OWPs will be available to spouses of international students enrolled in:

• Master's programs that are 16 months or longer
• Doctoral programs
• Select professional and eligible programs

Eligibility for Foreign Workers

OWPs will be available to spouses of foreign workers employed in:

• TEER 0 or 1 occupations
• Select TEER 2 or 3 occupations in sectors with labor shortages or linked to government priorities, such as:
  • Natural and applied sciences
  • Construction
  • Healthcare
  • Natural resources
  • Education
  • Sports
  • Military

A comprehensive list of eligible occupations will be released on January 21, 2025.

Additional Eligibility Requirements

• Foreign workers must have at least 16 months remaining on their work permit at the time their spouse applies for the OWP.
• Dependent children of foreign workers will no longer be eligible for family OWPs.

Existing Permits and Renewals

• OWPs approved under previous measures will remain valid.
• In-Canada family members can renew their work permits if:
  • They are applying under the same criteria as the current work permit.
  • The requested duration of the renewal matches that of the principal applicant's study or work permit.

Exemptions

• Spouses of workers covered by free-trade agreements.
• Spouses of workers transitioning to permanent residence.

Alternative Options

Family members who no longer qualify for family OWPs can apply for other types of work permits under Canada's work permit programs.
