Canada to launch a new pilot for Excluded Family Members- Measures taken for vulnerable workers & newcomers too

As another step to support family reunification in the country, the liberal government of Canada has announced to launch a new immigration pilot for the family members not included/declared earlier in the Canada immigration application of their sponsors. Such applicants are banned to be sponsored to Canada under Regulation 117(9)(d) introduced in 2002 to tackle fraud and misrepresentation based on the presumption that non-disclosure is motivated by the deliberate intention to deceive.

What's the new pilot for Excluded family members?

As mentioned above, section 117(9)(d) of the Immigration and Refugee Protection Regulations imposes a lifelong sponsorship ban on family members who were not examined at the time of the sponsor's immigration to Canada, as were not disclosed at that time by the applicant. The lifetime ban has been among the disputes, with the Canadian Council for Refugees (CCR) calling it "a significant barrier" to family reunification in Canada.

However, now the liberal government is finally planning to allow the Sponsorship applications for such family members who were earlier banned from acquiring Canadian PR, under a new 2 year pilot program. This has been announced by Mr. Ahmed Hussen- Canada's Minister of Immigration, Refugees and Citizenship. The pilot will focus on the non-accompanying family members who were not stated and hence, were not examined by the authorities when the sponsor applied for Canadian PR.

As per Mr. Hussain, the federal government considers that the regulation was unfair. He said, "Newcomers who failed to declare immediate family members as they first came to Canada were barred to sponsor them. Today, we right that wrong,"

The new Immigration pilot announced by the government will be active from September 9, 2019, to September 9, 2021 and as per Immigration Refugees and citizenship Canada, the applications that are already in process will get the advantage.

Steps taken for vulnerable workers and family members

As per an important announcement by the government, with effect from June 4, 2019 Immigration Refugees and citizenship Canada will allow open work permit to those employer-specific work permit holders, who are in an abusive job situation. As per IRCC, this will allow the migrant workers to leave that employer straightaway, maintain their status and look for another job."

Moreover, IRCC also plans to implement changes that will allow newcomers facing family violence to apply for a fee-exempt temporary resident permit with effect from July 26. This permit shall provide such people legal status in the maple leaf country and offer them a work permit along with health care coverage.

Speaking about the changes, Mr. Ahmed Hussen said, "No worker should fear losing their job when they are being mistreated in their place of work. No partner should be more fearful of losing their immigration status instead of escaping abuse,"
