Are you Eligible to apply for Canadian Spouse/Dependent Visa? Find out the Criteria

Every year, a huge number of people apply for family sponsored visas to immigrate to Canada from India. Most of these people apply for the Canadian Spouse or dependent visa in Canada. If you are one such aspirant of Canadian spouse or dependent visa in Canada, you must know whether you are eligible to apply for the same or not.

 

Canadian Spouse or Dependent Visa

To apply for Canadian spouse or dependent visa, you need to meet certain criteria. Find out the details regarding the same for every dependent category:

  • Criteria for Spouse

To apply for the Spouse visa, a spouse can be either sex and need to be:

  • legally married and
  • minimum 18 years old
  • Criteria for Common-law partner

A common-law partner:

  • isn’t legally married
  • can be either sex
  • is minimum 18 years old
  • has been living with the partner for minimum 12 consecutive months, meaning you’ve been living together continuously for 1 year in a conjugal relationship, without any long periods apart

You require providing proof of your common-law relationship.

  • Conjugal partner

A conjugal partner:

  • isn’t legally married or in a common-law relationship with the partner
  • can be either sex
  • is minimum 18 years old
  • has been in a relationship with you for a minimum of one year
  • lives outside Canada
  • can't live with the partner in the present country of residence or marry him/her because of substantial legal and immigration reasons

Moreover, you require providing an evidence showing that you could not live together or marry, in the present country (i.e. proof of rejected long-term stays in each other’s country.)

  • Dependent children

Children meet the requirements as dependants if they fulfill both of the below requirements:

  • they’re under 22 years old
  • they don’t have a spouse or common-law partner
  • Children 22 years or older

Children 22 years old or older qualify as dependants if they meet both of these requirements:

  • they are incapable to financially support themselves because of a mental or physical condition
  • they have depended on their parents for financial support since before the age of 22

With the exception of age, the dependent child needs to continue fulfilling these requirements until the Immigration Refugees and Citizenship Canada (IRCC) finish processing your application.
