Latest Changes to the UK Immigration Rules will take effect from 2016

  • In the Tier 2 general monthly quota, with effect from October 2015, the points allocated for salary bands have changed, in such a way that requests with low salary are more vulnerable to get denied
  • In case a Home Office rejects visa allocation to a sponsored migrant with the reason that it does not think a “genuine” job opening exists, it will investigate and may also suspend the employer’s Sponsor License during the investigation period
  • In the cases where Tier 4 migrants are switching into the Tier 2 (General) category, certain limitations have been launched, including that the institution where Tier 4 Student studied and got a degree, must be publicly funded.
  • EEA Nationals applying for British citizenship:e.f. 12 November 2015, EEA nationals applying to naturalize as British Citizens MUST first acquire a document certifying Permanent Residency in the UK. Formerly, EEA nationals could evidence having obtained PR “presumptively” as part of their application for Citizenship. The completely separate applications are now needed.
  • The Tier 2 Migrants submitting application for Indefinite Leave to Remain (ILR) in the UK must have a salary of at least GBP 35,000 (or the minimum as specified in the Code of Practice (COP), whichever is higher), on, or after 6 April 2016. This is applicable subject to limited exceptions.
  • Additional responsibilities have been announced for Tier 2 sponsor’s compliance
