Canada Immigration Latest update in OINP Employer Application Requirements

Ontario Immigrant Nominee Program (OINP) is the key Provincial Nominee Program (PNP) of the Ontario Province in Canada. Every year, a huge number of people apply in OINP to get the permanent residency in Ontario, Canada. Ontario as it is a wonderful place to live, work and settle on a permanent basis.

Recently a new update is announced in the Employer Applications being submitted in Ontario Immigrant Nominee Program (OINP) regarding the requirement of three years active business.

As per the requirement, employers submitting applications in OINP must show that they have been in active business in last 3 years prior to submitting the application. It includes the following:

Recently amalgamated corporations

It includes the recently amalgamated corporations, who are able to show that

  • Reformation is not going to impact the employment opportunities of the people in Ontario.
  • The business has been in regular operation for last three years
  • Employment offers to prospective nominees are still valid.
Conditions for employers who have been amalgamated in last 3 years

To meet the above parameters, employers who have been amalgamated in last 3 years need to give below documents:
  • A Written statement illuminating the need for overseas workers if layoffs took place as a consequence of amalgamation.
In case the amalgamation occurred before submission/approval of employer application

In a situation, where the amalgamation has occurred before the submission or approval of application from employer, the employer needs to provide:
  • Any of the below
  • Revenue Canada Schedules 125 (Income Statement Information) and 141 (Accounting Practitioner Information) OR
  • The Ledger statements of the company signed by a certified accountant for the pre-amalgamated and post-amalgamated corporations covering the three years prior to the application being submitted.
  • Revenue Canada T4 Summary for the pre-amalgamated and post-amalgamated corporations covering the 3 years before the application being submitted
If the amalgamation occurred after the approval of employer application

In this case, the employer requires providing an updated job offer letter for each position. The new job offer needs to match the main information that was approved by the program during the employer pre-screen application procedure.

Particularly, the position need to:
  • Be full time as well as permanent
  • Have the same NOC (National Occupational Classification) code as the earlier offer
  • Offer the same salary or higher as the earlier offer and
  • Be for same office hours as the earlier offer.
