Canada- the New Employment Laws have been introduced for the foreign & temporary workers of Ontario

visas default image The province of Ontario in Canada has amended its employment law, i.e. Employment Standard Act of 2000 and the changes will take effect from November, 20, 2015. As per the new changes in Employment law announced, the temporary and foreign workers hired through a help agency, will be able to recover their unpaid wages both from the said agency and its client-business in a scenario, where the agency has failed to pay the wages.

Good news for Assignment Employees

Hence, the agency and its clients will now be responsible for the payment of the complete amount of unpaid wages both together or separately, in case the agency does not pay the assignment employee partial or complete amount of the wages. Apart from this, the bill 18 of the same also confirms that the assignment employees will no longer wait for the proceedings to complete against the help agency, for their wages.

Moreover, the temporary help agency and its clients will now have to maintain the record of working hours/days for which an assignment employee has worked for at least 3 years.

Rights for the foreign workers

The Employment Protection for Foreign Nationals Act, 2009 has also been applied to the entire foreign national, who are working or seeking the job in Ontario, via an immigration or foreign temporary employee program, earlier, it was only to overseas caregivers and their employers.

With the implementation of the new changes, the recruiters cannot charge, directly or indirectly any amount to the workers for goods, services, benefits or placement, and recruitment, etc. The recruiters are also not permitted to keep the property of foreign nationals, i.e. their passports or work permits, etc.
