Australia Passes New Bill to make Key Changes in Partner Visa application Process

Australian government has passed a new Migration Amendment bill (Family Violence and Other Measures) which is likely to bring vital changes to the way Australian partner visa is being applied. It will determine whether or not one can submit partner visa application while being in Australia at the time of loading the application. Let's find out more about the likely partner visa changes.

New bill has been passed on December 10, 2018. However, it is not confirmed as to when exactly when it will come in to effect as a law. Let's find out the likely changes.

Once the new changes implemented, the partner will have to first lodge their sponsorship application and wait till it gets approved and then only lodge the partner visa application. The time to be taken for sponsorship decision is not known as of now. Presently, the total processing time is about 12-18 months.

Who will be affected by the new changes?

The Partner visa applicants who are left with the short time on their present visa will be asked to either lodge a genuine visa application that will permit them to live in the country, or leave Australia until the partner visa is approved. Moreover, till the time an appropriate visa application is lodged being in Australia, the applicant will not be eligible for a BVA, Medicare or (in some instances) full work rights.

What is ongoing Procedure?

A now in Partner permanent residence applicant requires to be sponsored by an Australian citizen, permanent resident, or eligible New Zealand citizen. Together, the applicant and their partner submit their applications to the DHS.
